Honestly where did this extra one constituency called, the National tallying centre come from? We have 290 plus one diaspora constituencies yes, but why are we talking about the national tallying centre being an existent constituency?
I'm not a constitutional or any other lawyer for that matter, but no doubt, the attorney general " played us here". This argument that Wafula Chebukati, IEBC chairman is the presiding officer at the national tallying centre- Bomas- constituency, was a psychological ploy. I don't want to prophesy doom, but this argument adopted by the nation is toxic.
How did he become a returning officer of an imaginary constituency? I expect somebody to help me understand this. If we assume he is the RTO for Bomas constituency, then the question that begs an answer is if that constituency is consistent with article 89 on the definition and description of what constitutes a constituency?
My concern is, through this narrative Kenyans can forget or ignorantly ignore the Judicial interpretation made by the court of appeal, the presidential votes tally from the constituency as provided by the constituency returning officer is final subject only to a Supreme court ruling.
Let's be honest, The commission chairman at the Bomas is not a returning officer. He is not counting any votes but merely tabulating. There is no voting at Bomas. His role is just announcing the results, after all I will also be doing my own tallying in my house, ha ha ha. The point is, The commission chairman will not change the results as they stream in.
