IEBC IS NOT EZRA CHILOBA AND EZRA CHILOBA IS NOT IEBC

IEBC is a constitutional independent commission. It is not synonymous to Ezra Chiloba, Tororey, Kasait, Muhati or Chebukati. These are individual Kenyans who are separate entities from the commission. You can axe the entire Secretariat which bungled our democracy and replace them with a diametrically new breed of Kenyans with integrity and still IEBC will be IEBC.

Just in case you didn't know, When the Supreme judges directed the First respondent to organize a fresh presidential election. The court by no means insinuated or implied Ezra Chiloba and his team should organize a new election. It was the IEBC not individuals. These individuals are not the IEBC though they at that time constituted it.

These individuals though make up the IEBC are not themselves IEBC. You can sack them or sideline them but IEBC still will remain functional with the new team. Am saying that these individuals are not permanently in IEBC especially when they are to take responsibility for irregularities and illegalities committed in the election process. When they go voluntarily, by dismissal or expulsion, IEBC still will be reconstituted. IEBC remains when they are gone.

A good example is former IEBC ICT manager, Christopher Chege Msando, he was gruesomely  demised by operatives yet IEBC still went ahead   with the elections he was enthusiastic to ensure were done in tandem with the prevailing laws.

Isaac Hassan was in the commission with his team. They vacated office yet the commission is still existing. The Secretariat they left was the one which over saw the recently conducted shambolic elections. The same case to Samuel Kiviutu and his commission members.

It is on this premise where one ought to delineate the IEBC as a commission from the individuals constituting the commission. If we take this to consideration then we will not bigotly hold that the supreme court judgement gave a clean bill of health to the defunct IEBC Secretariat. Defunct because they plunged the country into disarray. Now 12 billion is going to waste just because a few rogue people could not not do their job competently and with integrity. And in the midst of all this the person who bears the burden is the taxpayer. A king size amount of taxpayers money that could be used to improve lives of Kenyans is going to be used to redo a process that was ignorantly and arrogantly bungled.

The IEBC Secretariat plummeted way below the standards of moral integrity contemplated in the spirit of our constitution. They, in the words of NASA presidential flag bearer belong to jail. The country cannot lose such a collosal amount of taxpayers money just because a few individuals decided to meddle with such a critical process for selfish gains. Somebody must be held to account for the courts findings.

The verdict of the supreme court ruling did not limit the first respondent to Chiloba and his team. In a sense that they are the first respondent the court contemplated to organise a fresh election. Perhaps - as latter could arise -. The court to find the IEBC Secretariat or specific members of the Secretariat to be legible for prosecution due to their culpability in the just nullified election process.  It is the IEBC, the first respondent  to conduct elections not  Ezra Chiloba and his team who cost the country this grave loss of over 11 billion Kenya shillings.
